MULTI-STATE CONSUMER PRIVACY NOTICE (COLORADO, CONNECTICUT, MONTANA, OREGON, TEXAS, UTAH, VIRGINIA)
This Multi-State Notice ("Multi-State Notice") provides additional information to Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Virginia and Utah residents whose Personal Information is collected by us pursuant to the respective state laws, including the Colorado Privacy Act, Connecticut Data Privacy Act, Delaware Personal Data Privacy Act, Iowa Consumer Data Protection Act, Montana Consumer Data Privacy Act, Nebraska Data Privacy Act, New Hampshire SB255, New Jersey SB 332; Oregon Consumer Privacy Act, Texas Data Privacy and Security Act, Virginia Consumer Data Protection Act, and Utah Consumer Privacy Act. Please see our Privacy and Cookies Policy ("Policy") for more information. Any capitalized terms undefined in this Multi-State Notice have the same definition as the Policy. This Multi-State Notice is applicable to all the identified states unless there is a state-specific provision identified.

Your Rights and Choices and How to Exercise Them
Right to Know
Under applicable state laws, you may have the right to request that we disclose to you the following information about Personal Information we collect from you:
- categories of personal information collected;
- categories of sources of personal information collected;
- to confirm if we are processing personal information;
- the business or commercial purpose for collecting or selling personal information;
- the categories of third parties with whom we share personal information; and
- the specific pieces of personal information we have collected about you.
You also have a right to know if we have sold or shared your Personal Information for a business purpose if so, the categories of Personal Information sold or shared and the categories of third parties to whom the Personal Information was sold or shared. You also have a right to know the categories of Personal Information disclosed for a business or commercial purpose.
Information We Collect
Personal Information
Your interactions with Weber-Stephen Products LLC and its worldwide subsidiaries and affiliates (collectively, "Weber") and use of Weber Consumer Care, mobile applications, promotions and websites (collectively "Applications") result in the collection of information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("personal information"). In particular, Weber Applications have collected the following categories of personal information from some or all of its consumers within the last twelve (12) months. Please see our Privacy and Cookies Policy for more details.
- Personal Information including personal identifiers, your name, address, email address, phone number, and credit/debit card information.
- Commercial information including financial information, credit/debit card information
- Internet Activity on our Applications including website history, search history, purchase behavior, IP address, general location information (city and/or state), and other information regarding your interaction with our Applications
Weber obtains the categories of personal information listed above from the following categories of sources:
- Directly from you. For example, from forms you complete as a consumer, your interactions with Consumer Care, or products and services you purchase or otherwise receive from Weber.
- Indirectly from you. For example, from observing your actions on our Website and engaging in analytical analysis, or if you were to participate in consumer research regarding our products through a third party service provider of Weber.
Sensitive Personal Information
Under applicable laws, consent is required for the processing of certain sensitive personal information. We do not process, use, or disclose sensitive personal information under the applicable laws of the Multi-State Notice. In the advent of any changes, we shall obtain your consent prior to the collection of any sensitive personal information as defined under applicable law.
Opt Out of Selling of Personal Information
Under applicable state law, you have the right to opt out of the sale of your Personal Information. The applicable laws generally define the "sale" of personal data as the exchange of personal data for monetary consideration by a controller to a third party. As explained further in Privacy and Cookies Policy, we and our third-party partners such as social networking sites and advertising companies, share your data in order to serve you with ads tailored to your preferences across various platforms. This type of sharing is not considered a "sale" under the applicable laws, but see our section on your rights regarding targeted advertising below. If our practices change we will make sure to inform you regarding any sales of your information.

Please Note:
- Opt-outs are device and browser based. You must opt out on each device and each browser where you want your choice to apply.
- Opt-outs maybe stored via cookies. If you clear cookies, your opt-out may no longer be valid and you must opt out again where you want your choices to apply.
- We may still share your Personal Information with our service providers that help us perform functions that are necessary for our business such as vendors that host our Site, analytics processors, etc. These entities are contractually obligated to keep this information confidential and not use it for any purpose other than for the services they provide to our business.
- You may still receive ads from us that are not tailored to your interests.
Opt Out of Data Processing for Targeted Advertising or Profiling Purposes Request Rights
Under applicable state laws, you may have the right to opt out of the processing of your Personal Information with third parties. To make such a Request, please submit a verifiable consumer request pursuant to the instructions here.
Access Information About and Opt Out of Automated Decision-Making Request Right
You have a right to request access to information about automated decision making processes. Weber does not use automated decision making technology. To inquire about automated decision making, please email us at privacy.americas@weberstephen.com.
Non-Discrimination for Exercising Consumer Privacy Rights
Under applicable state law, you may have the right not to receive discriminatory treatment for exercising your privacy rights conferred under your respective state, including by exercising the rights specified herein. As the Right to Non-Discrimination is effective across the board, there is no specific "request" that you need to make in order to exercise this right.
Correction Request Rights
Under applicable state law, you may have the right to request that we rectify inaccurate information about you.
To make a Request to Correct, please submit a verifiable consumer request pursuant to the instructions here. We will attempt to respond substantively within 45-90 days.
Deletion Request Rights
Under applicable state law, you may have the right to request the deletion of your personal data provided by or obtained about you ("Request to Delete"), subject to certain exceptions permitted by law. To make such a Request, please submit a verifiable consumer request pursuant to the instructions here.
Access to Data Portability Right
You can request a copy of your Personal Information in an easily accessible format and information explaining how that information is used.
To make a request for your personal information, please submit a verifiable consumer request pursuant to the instructions below. We will attempt to respond substantively within 45-90 days.
Exercising Access, Data Portability, Deletion, Correction, Limitation and Do Not Share Rights
To exercise the access, data portability, correction, and deletion rights described above, please submit a verifiable consumer request to us by either:
- Opening a ticket with our data access ticket system.
- Adjust your cookie preferences in the Cookie Preference Center (to complete a self service "do not share" rights request) as described in Section 4 ("Cookies") of the Privacy and Cookies Policy.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
- You can designate an agent to make a request on your behalf either: (1) by having your agent send us a letter, signed by you, certifying that the agent is acting on your behalf and showing proof that they are registered with the California Secretary of State; or (2) by you and the agent executing and sending us a notarized power of attorney stating that the agent is authorized to act on your behalf. Please note that we may still require you to verify your identity before we process a request submitted by your agent.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requesters identity or authority to make the request.
Response Timing and FormatWe endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period.
We will deliver our written response by mail or electronically, at your option (depending on how you make your request).
Any disclosures we provide will only cover the information included in the verifiable consumer requests receipt, except where providing such information is impossible or involves effort disproportionate to the request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
To exercise your right not to share your personal information, which activity is conducted through so-called third-party cookies, please visit the Cookie Preference Center as described in Section 4 ("Cookies") of the Privacy and Cookies Policy.
Appeals of Decisions by Weber
If you are a resident of one of the states outlined in the Multi-State Notice, you have the right to appeal our decision to deny any of your privacy rights requests above. Within 45 days of receipt of your appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions.

We reserve the right to deny appeals in certain circumstances, such as where we have a reasonable belief that the request is fraudulent.

Retention of Personal Information
We will retain your Personal Information for as long as it is necessary for the purposes set out in the Privacy and Cookies Policy and to the extent necessary to comply with our legal obligations (for example, if we are required to retain your Personal Information to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
