eGift Card Terms and Conditions

These eGift Card Terms and Conditions apply to the creation and distribution of eGift Cards for use on www.weber.com (“Gift Cards”).
General Terms
The Gift Cards are issued by Weber-Stephen Products LLC, a Delaware corporation ("Weber" or “We”). By visiting www.weber.com, you agree that the laws of the State of Delaware without regard to principles of conflict of laws, will govern these eGift Card Terms and Conditions ("Gift Card Terms & Conditions"). Weber reserves the right to change these Gift Card Terms & Conditions from time to time to their discretion. No fees apply to Gift Cards. We reserve the right to require additional verification of your identity, Gift Card, or provision of an additional payment instrument before you are able to apply a Gift Card to a purchase. If any of these Gift Card Terms and Conditions are deemed invalid, void, or for any reason unenforceable, that unenforceable term will be deemed severable and will not affect the validity and enforceability of any remaining Gift Card Terms and Conditions.
Returns
Once you place your Gift Card order you may not return or cancel your Gift Card.
Checking Your Gift Card Balance
You may review your Gift Card balance at www.weber.com/US/en/giftcard/ or in your online cart during the checkout process at www.weber.com/US/en/cart/.
Lost or Stolen Gift Cards
If you suspect that someone has copied or stolen your Gift Card, contact Weber Customer Support immediately at support@weberstephen.com. Gift Cards will not be replaced if lost or stolen without the purchaser's confirmation email as proof of purchase. If you provide proper proof of purchase, any remaining balance on your Gift Card can be re-issued to you on a new Gift Card. Gift Cards have cash value and should be safeguarded accordingly.
Limitations
You may not use a Gift Card to purchase other Gift Cards. Gift Cards cannot be resold, transferred for value, or redeemed for cash, except to the extent required by law. Void if resold, transferred for value, or redeemed for cash. Unused Gift Cards may not be transferred. Gift Cards may only be redeemed toward the purchase of eligible goods provided by Weber on Weber.com. Eligible goods are subject to change in our sole discretion.
Our Policies
All Gift Cards are subject to Weber's Privacy and Cookie Policy. Weber may provide Gift Card purchasers with information about the redemption status of their Gift Cards.
Risk of Loss
Ownership and risk of loss of Gift Cards passes to the purchaser as soon as we send the confirmation email to the recipient. We are not responsible for lost or stolen Gift Cards. If you have any questions, please see the eGift Card FAQs.

Delivery Information and Requirements for Gift Card Purchasers
All Gift Card orders are subject to a process that compares purchaser information provided on the web site with information about the purchaser provided by the purchaser's financial institution (credit/debit card charge). If there is a discrepancy, your Gift Card order may be delayed until it can be corrected. If you have concerns about your order, please contact Weber’s Customer Support. Please refer to your order number, or be ready to supply your email address. We are not responsible for Gift Cards that are undeliverable or not received due to your failure to enter an accurate email address for the recipient.
Reasons for Failed Gift Card Delivery
If you have confirmed the your email address but the Gift Card has not been viewed within a reasonable period after the requested delivery date, the following is a list of the most common reasons why delivery may have failed:
- Spam filter blocked email or routed it to a bulk/spam folder
- Recipient's firewall blocked the email
- Email inbox is over size limit
Invalid email address If a spam filter is blocking service-us@weber.com emails from getting to an inbox, the email options will need to be modified so that service-us@weber.com emails are not considered spam.

Limitation of Liability
NEITHER WEBER OR ITS RESPECTIVE AFFILIATES MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
Disputes
Any dispute or claim relating in any way to Gift Cards will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The U.S. Federal Arbitration Act and U.S. federal arbitration law apply to this agreement.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow these Gift Card Terms and Conditions as a court would.
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our corporate address at 1415 Roselle Rd. Palatine IL 60067 with notice addressed to the legal department. The arbitration will be conducted by the American Arbitration Association ("AAA") under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. We will reimburse those fees for claims totaling less than $10,000 unless the arbitrator determines the claims are frivolous. Likewise, we will not seek attorneys' fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person at a mutually agreed location.
We and you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We and you also agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
